Do you own a Lemon Car? What can be done about it?

Your car is termed as a lemon, if under warranty time, your vehicle stays more in repairs than on the road. If you think you have a lemon, the Lemon Laws of the State give you some rights. Check out these provisions of the New Mexico Lemon Law.

The Lemon Law in New Mexico provides-

1) The full recovery of lawyer’s fees
2) Full refund or replacement of the lemon car. Do note that this will exclude the mileage offset (deducted towards usage of the car till it was declared a lemon)
3) The dealership must get reasonable number attempts to fix the issue, but yet remains unsuccessful.
4) Lemon Law in New Mexico applies to used vehicles as well.
5) Your repairs must occur in the first year of the purchase of the vehicle.

Timing is important

The more the user waits to file a claim, the more likely his claim will be rejected. This is because the more he uses the car, the more there will eb wear and tear. Hence it will be difficult to judge if the defect is due to user carelessness/ driving behavior or due to a defect at the manufacturing stage. If the defect is in a new car, then it becomes very easy to pin the blame on manufacturer as the user is still to use it extensively (i.e. in the 1st year).
