Your Warranty Just Got Protection!

Is it not the absolute best when your law protects your warranty? Well, the Magnuson Moss Act came into the picture in 1975, giving the much-required protection to the federal warranties.

To explain the Federal warranties in the USA:

1. The express warranties are explicitly and separately mentioned in writing to the customers.
2. The implied warranties are mentioned in the brochure or the catalogues and are implicative during the sale.

The Magnuson Moss Act was enacted to make sure the manufacturers honour their warranties.

The Magnuson Moss Warranty Act is the relief provided to customers suffering from the purchase of a lemon. After the exhaustion of the arbitration, when the parties are still dissatisfied, a relief of a civil suit is available to the aggrieved. The civil suit can be filed under the Magnuson Moss Warranty Act to claim the relief from the purchase of a lemon.

While the lemon laws ensure the adequate remedy to both parties, the Magnuson Moss Act provides the remedy to the customer who has been a victim of the fraudulent sale of a lemon. Here is how the act provides relief:

The warrantor is to pay for the attorney in a successful lawsuit.
The manufacturer is obligated to honour the warranties provided.
The consumer is protected from being misled about the nature and the scope of the warranty being provided to them.
The substantive knowledge of the Magnuson Moss Warranty Act will help you deal with your lemon. The customer may seek relief under both the state lemon laws and the Magnuson Moss Act.
